General terms and conditions

1 Contract basics

All contracts that the customer concludes with Messner Optik GmbH (hereinafter referred to as the seller) via the Internet or by other means of remote communication are exclusively based on these GTC. The customer expressly accepts these with his order.

2 Health note

Wearing contact lenses and using contact lens care products and accessories can affect the health of your eyes. For this reason, the seller supplies products only if the following conditions are met by the customer.

Voraussetzungen
The customer is already familiar with wearing times and handling of the lenses, care products and accessories. The customer regularly attends the eye examinations and fit checks required by the contact lens specialist in order to avoid eye damage caused by the contact lenses.

The Customer confirms that the contact lenses purchased through the Seller will always be carefully cleaned and cared for exclusively in accordance with the optician's instructions and will not exceed the recommended wearing times, otherwise the quality of vision and eye health may be impaired.

The customer confirms that there is no recommendation/instruction from the optician to stop wearing contact lenses. Furthermore, he confirms that he will immediately discontinue the contact lenses and contact his ophthalmologist and optician as soon as redness, deterioration of vision or eye irritation occurs. The Seller assumes no liability for incorrect use and handling of contact lenses, their care products and accessories. Likewise, the seller assumes no liability if any of the requirements are not met by the customer.

3 Offer and conclusion of contract

The customer's orders placed in writing, by telephone, via online store or email are offers to which the customer is fundamentally bound. The contract is concluded by order confirmation, receipt of payment and delivery of the goods.

Any obstacles to delivery shall be notified to the customer by the seller without undue delay, but no later than within one week.

Data communication via the Internet cannot always be guaranteed to be error-free. We are therefore not liable for constant and uninterrupted availability of our online store, nor for technical and electronic errors during a sales event over which we have no control, in particular for delayed processing or acceptance of offers.

The offers of the seller are subject to change and are subject to the timely self-delivery and availability of the goods, unless otherwise expressly agreed in writing in individual cases. An impossibility of delivery or non-compliance with delivery dates due to total or partial unavailability of the goods entitles the customer to withdraw from the contract after the fruitless expiry of a reasonable, but at least fourteen-day grace period. The customer shall not be entitled to any further rights in this case.

4 Right of withdrawal

The right of withdrawal according to the Code of Obligations applies. If the revocation arrives at the seller before or with the application, or if it is brought to the attention of the seller in case of later arrival before the seller has taken note of the application, the application shall be deemed not to have been made. 5 Prices and shipping conditions

The prices invoiced by the seller at the time of the last order shall apply. The seller reserves the right to correct obvious errors.

The prices are in Swiss francs and include the statutory value added tax.

Packaging and shipping costs are borne by the buyer.

The goods are shipped with the parcel service of the Swiss Post.

The seller reserves the right to exclude individual methods of payment to the consumer.

The goods are delivered exclusively to Switzerland.

Benefit and risk are transferred to the buyer when the goods are handed over to the logistics company commissioned by the seller.

6 Privacy policy

All personal data will be treated confidentially in accordance with the provisions on data protection. More detailed information is available and can be viewed by the customer on the website of the seller.

7 Others

Agreements deviating from or supplementing these terms and conditions in individual cases must be made in writing to be effective.

8 Jurisdiction

The exclusive place of jurisdiction for any disputes arising from the present contract shall be Basel-Stadt; Swiss law shall be applicable.

9 Severability clause

Should one or more clauses of these GTC be invalid, this shall not entail the invalidity of the entire contract. The invalid provision shall be replaced by the relevant statutory provision.
